Terms and Conditions (GTC)

1. Scope

1.1. These General Terms and Conditions (hereinafter "GTC") apply to all contracts between EU-Expedition SRL (hereinafter "we", "us") and our customers (hereinafter "customer", "you") regarding the use of our freight forwarding services for heavy transport within Europe.

1.2. Any deviating, conflicting or supplementary general terms and conditions of the customer shall not become part of the contract, even if known, unless their validity has been expressly agreed to in writing.

2. Subject matter of the contract

2.1. We offer forwarding agency services for heavy transport within Europe.

​

2.2. The details of the agreed services are set out in the individual contracts between us and the customer, including the scope of the service, transport route, costs and payment terms.

3. Conclusion of contract

​

3.1 The contract between us and the customer is concluded by the written confirmation of our services or by the signing of a written contract.

4. Prices and payment terms

​

4.1. The prices for our services are agreed individually and may vary depending on the scope of the service and the transport route.

​

4.2. All prices are exclusive of the applicable statutory value added tax.

​

4.3 Payments must be made within the agreed period without deduction, unless otherwise agreed in writing.

​

4.4. If the customer defaults on payment, we are entitled to charge default interest at a rate of 5 percentage points above the respective base interest rate of the European Central Bank.

5. Liability

​

5.1 We are liable in accordance with the statutory provisions for damages resulting from gross negligence or intent on our part.

​

5.2. We accept no liability for damage caused by third parties, in particular freight forwarders or transport companies, unless we have selected or supervised the third-party providers intentionally or with gross negligence.

​

5.3 Liability for minor negligence is excluded unless it involves a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on whose compliance the customer can regularly rely.

7. Final provisions

7.1 Any changes or additions to these Terms and Conditions must be made in writing.
